2. Definitions

  • Consumer – any natural person who acquires goods that are not intended for commercial or professional activity.
  • Goods – any product offered for sale through the Site.
  • Order – a request to purchase selected goods, made by the Customer through the Site.
  • Distance contract – a contract concluded between the Seller and the Consumer through the Site, without their simultaneous physical presence.

3. Subject

3.1. Through the Site, the Seller enables Customers to purchase the goods on offer — mainly natural herbal products, food supplements, honey and cosmetics.

3.2. The Seller reserves the right to change the range, prices and availability of goods at any time without prior notice.

4. Registration and user account

4.1. Orders may be placed with or without registration, where the Site offers this option.

4.2. When registering, the Customer undertakes to provide true, accurate and up-to-date information. The Customer is responsible for keeping their account login details secure.

4.3. The Seller may refuse or terminate a registration in the event of a breach of these Terms and Conditions.

5. Placing an order and conclusion of the contract

5.1. The Customer places an order by selecting goods, adding them to the cart and entering the required delivery and payment details.

5.2. Before completing the order, the Customer can review and correct the details entered and the contents of the cart.

5.3. The order is placed once the “Place order” button is clicked, which creates an obligation to pay.

5.4. The distance sales contract is concluded when the Seller confirms the order — by email or by phone.

5.5. The Seller may refuse or cancel an order if goods are out of stock, if there is a pricing error, if the Customer cannot be contacted or if abuse is suspected. In such cases the Seller will notify the Customer and refund any amounts paid.

6. Prices and payment methods

6.1. All prices on the Site are final and are stated in euros (EUR), unless expressly stated otherwise.

6.2. The delivery charge is shown separately before the order is completed.

6.3. The Seller reserves the right to change prices at any time; for orders that have already been confirmed, the price at the time of ordering applies.

6.4. Payment methods:

  • Online payment by debit/credit card, as well as the other online payment methods offered at checkout (e.g. BLIK, EPS, Bancontact, Link), processed securely by Stripe;
  • Cash on delivery – available only for orders delivered to an address in Bulgaria.

7. Delivery

7.1. Within Bulgaria, orders are delivered by the courier companies Speedy or Econt (to an office, a parcel locker or an address). Orders to other countries are sent by tracked international delivery.

7.2. Delivery within Bulgaria usually takes about 3 working days after the order is confirmed, unless otherwise agreed. Estimated delivery times for other countries are given on the Deliveries page of the Site.

7.3. Delivery prices and conditions are set out in the “Deliveries” section of the Site and are confirmed before the order is completed.

7.4. On receipt, the Customer may inspect the parcel where the courier allows this. If the packaging is visibly damaged, the Customer should notify the courier and the Seller.

7.5. The risk of loss of or damage to the goods passes to the Consumer when the goods are received by the Consumer or by a third party designated by the Consumer.

8. Right of withdrawal

8.1. Under the Bulgarian Consumer Protection Act, the Consumer may withdraw from a distance contract without giving any reason within 14 (fourteen) days from the date of receipt of the goods.

8.2. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by an unequivocal statement (by email to support@getmacun.com or using the standard withdrawal form) within that period.

8.3. The Consumer must return the goods within 14 days of the date of the notification. The direct cost of returning the goods is borne by the Consumer, unless otherwise agreed.

8.4. The Seller will refund the amounts received (including standard delivery costs) within 14 days of the notification, and may withhold the refund until the goods have been received back or the Consumer has supplied proof of having sent them.

8.5. The goods must be returned in their original packaging, unused, with labels and protective seals intact.

8.6. Exceptions to the right of withdrawal (Art. 57 of the Consumer Protection Act): The right of withdrawal does not apply to:

  • goods which, by their nature, are liable to deteriorate or have a short shelf life;
  • sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery (e.g. food supplements, foods, cosmetics);
  • goods made to the Consumer’s order or according to their individual requirements.

9. Complaints and guarantees

9.1. The Consumer has the right to make a complaint if the goods do not conform to the contract, in accordance with the Bulgarian Act on the Provision of Digital Content and Digital Services and on the Sale of Goods.

9.2. Complaints should be sent to the Seller at support@getmacun.com, stating the subject of the complaint, the preferred remedy and contact details, together with a document proving the purchase (order confirmation or payment document).

9.3. For food products and products with a stated expiry date, complaints are accepted provided the expiry date has not passed and the product has been stored correctly according to the instructions on the packaging.

9.4. If a complaint is justified, the Seller will bring the goods into conformity, replace them or refund the amount paid, in accordance with the law.

10. Nature of the products. Important information

10.1. Many of the products on offer are food supplements and/or foods, not medicinal products.

10.2. Food supplements are not a substitute for a varied and balanced diet and a healthy lifestyle.

10.3. Read the label and the instructions on the packaging before use. If you are pregnant or breastfeeding, taking medication, have a chronic condition or may be allergic to any of the ingredients, consult a doctor or pharmacist before use.

10.4. Do not exceed the recommended daily dose. Keep the products out of the reach of young children.

10.5. The information on the Site is for information purposes only and does not constitute medical advice, diagnosis or a treatment recommendation.

11. Personal data protection

11.1. The Seller processes Customers’ personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Bulgarian Personal Data Protection Act.

11.2. Detailed information on the purposes, legal bases and retention periods of processing, and on the rights of data subjects, is set out in the Privacy Policy published on the Site.

12. Cookies

The Site uses cookies to function properly and to improve the user experience. More information is available in the Cookie Policy.

13. Intellectual property

13.1. All content on the Site — texts, images, logo, graphics and design — is protected by the Bulgarian Copyright and Related Rights Act.

13.2. Copying, reproducing or using the content without express written consent is prohibited.

14. Limitation of liability

14.1. The Seller is not liable for damage resulting from improper use of the products or failure to follow the instructions on the packaging.

14.2. The Seller makes every effort to keep the information on the Site accurate and up to date, but does not guarantee the absence of technical errors or inaccuracies and reserves the right to correct them.

15. Changes to the Terms and Conditions

15.1. The Seller reserves the right to amend these Terms and Conditions at any time. The current version is published on the Site with the date of its last update.

15.2. Orders already placed are governed by the Terms and Conditions in force at the time of ordering.

16. Dispute resolution

16.1. All disputes shall be settled by negotiation and in good faith. If no agreement is reached, the dispute shall be referred to the competent Bulgarian court, in accordance with applicable Bulgarian law.

16.2. The Consumer may also refer the dispute to the Commission for Consumer Protection or to an alternative dispute resolution body.

17. Applicable law

Any matters not covered by these Terms and Conditions are governed by the legislation in force in the Republic of Bulgaria. This does not deprive consumers of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence.
